GLASGOW HERALD
20 APRIL 1972
ORDER STAYS BANNING DIVER FROM APPROACHING WRECK
Despite strenuous argument by his counsel that he was being prohibited from investigating “a wreck that is not there,” an Ardrossan diver failed to obtain Court Authority to continue diving for the lagan from an eighteenth-century Dutch ship in competition with a rival diving concern.
Mr R. E. Henderson, for Mr William Elliot, 15 South Crescent, South Beach, Ardrossan, carrying on business as Elliot & Company (Divers), told Lord Johnston, Court of Session vacation Judge, that an interim interdict granted against him last week grossly prejudiced his rights.
PARTNERSHIP
The Order prohibits Mr Elliot, or anyone acting for him, from approaching the wreck of the ADELAAR,, which belonged to the Dutch East India Company, and is said to have sunk on a reef off Barra known locally as the “cursed rock.”
It was granted by Lord Milligan on an unopposed application by a partnership comprising Mr Christopher Oldfield, managing director of Submarine Salvage Systems Limited, 68 Argyle Street, Birkenhead, and Mr Colin John Mackenzie Martin, a marine archaeologist, of Roxburgh Manse, Kelso.
The partnership claim exclusive right to explore the wreck or the objects found in the area where it is alleged to have foundered, and maintain they found it.
