AN IMPORTANT DECISION

In the Small Debt Court at Kilmarnock yesterday, Sheriff Mackenzie gave judgment in a test action at the instance of the Irvine and District Water Board against Alexander McCallum, contractor, Saltcoats.

The pursuer sued for payment of special rates alleged to be payable by the defender for water used in connection with the horses and carriages kept by him and levied by them in terms of their table of rates.

The defender pleaded that the summons was irrelevant in respect that the special rates had been illegally laid on, and that the pursuers had no power under their order to charge a special rate without deducting the general or domestic rate payable by him.

The Sheriff dismissed the summons as irrelevant and incompetent in respect that the pursuers had no power to enforce payment of a special rate in the manner in which it had been levied on the defender.
