FALL FROM SALTCOATS PROMENADE – COURT OF SESSION – BEFORE LORD DEWAR

The records were closed in actions by Mrs Morrison, widow, 25 Cuthill Road, Denmark Hill, London, and Thomas Taylor, engineer, 6 Glebe Street, Townhead, Glasgow, against the Burgh of Saltcoats for £1000 and £500 respectively in respect of personal injuries.

The pursuers, who are related, were, in August, 1911, in company with Mrs Taylor, walking along the promenade on the embankment overlooking the East Shore Saltcoats.

Mrs Morrison was leaning on Mr Taylor’s arm, when he slipped, and both fell down the embankment, a distance of about 15 feet. Mrs Morrison’s skull was fractured and Mr Taylor’s nose broken.

The pursuers attribute the accident to the unsafe condition of the promenade for foot passengers and to the failure of the defenders to remedy the defects.

The defenders deny fault, stating that the footpath of the embankment is private property, and is not under their control.

Issues for trial were ordered.

SALTCOATS DEAN OF GUILD COURT

A diet of this Court was held on Monday night – Councillor Bogle presiding, and Councillor Blackley.

The petition by Mr Ralph Brown to erect dwelling-houses in Canal Street was passed, that of Mr Thomas Miller was continued by consent.

Mr David Millar lodged a plan for structural alterations on a building. The Chairman asked if the petitioner or anyone representing him was present. A reply in the negative was given, and it was further stated that it had been customary to pass plans to which no objection was taken even if the petitioner was not present.

Councillor Bogle said it may have been the custom in the past, and it might possibly be a custom in the future, under certain circumstances, but he would not countenance it. He considered it was not respectful to the Court or its members, who may have come, at inconvenience to themselves, to perform the duties appertaining to the Court, and he thought the very least any petitioner could do was either to appear himself or have some responsible person representing them.

In order to emphasise this view, the Court declined to consider the plans, and the clerk was instructed to have the application continued till next Court.
