23 August 1813


On the 24th ult. James Tyre, or Macintyre, a native of Stevenson, Scotland, came to ardeer, seeking charity, and shewed a determination not to leave the house, unless his application was listened to, but was told by Mr. Warner that he would get nothing, and ordered to depart.

When Mr. Warner turned his back to him, to look after some labourers, the man drew a knife, and made an attempt to cut Mr. Warner's throat, but he, feeling an arm over his shoulder, put up his hand, and received a cut across the fingers and a large wound in his left cheek, and as he turned round, the fellow attempted to cut him across the breast, but succeeded only in cutting his jacket, upon which Mr. Warner went up to him, and knocked him down.

Mr. Warner, as soon as the man recovered upon his feet, saw the knife for the first time, and having seized him by the breast, the villain gave him a deep cut across the thigh, nine inches long, two inches wide, and one inch and a half deep. The man was instantly secured, and committed to the prison of Ayr. The trial is to proceed at the ensuing circuit. Mr. Warner was dangerously ill for some time, but is now out of danger.

The Court next proceeded to the trial of James M'Intyre, alias M.Tyre, alias Tyrie, accused of assaulting and wounding Mr Warner, of Ardeer, to the great effusion of his blood, and danger of his life. And the jury having returned a verdict finding the pannel guilty, he was sentenced to seven years transportation beyond seas, under the usual certification.
