ATTEMPTED SUICIDE

At Saltcoats Burgh Court MRS. HAGGARTY, wife of a fireman residing in Harbour Street, pleaded not guilty to a charge of disorderly conduct and attempting to commit suicide by standing in front of an approaching train at the Glasgow & South-Western Railway.

One of the witnesses, Alexander Brown, a miner, residing in Schoolwell Street, Stevenston, stated that on Saturday, 13th instant, he saw Mrs. Haggarty put down a child on the ground, climb a fence, and stand in front of a train. The train was about 300 yards off, and witness jumped over on the line and puller her away. She attempted to get in front of another train and afterwards fell down in a fit.

Mr. Kirkland, writer, for accused, said if an attempt at suicide was made it was while she was labouring under unnatural excitement. She was subject to periodical attacks of St. Vitus dance, during which she was out of her mind, and she has suffered from this since childhood.

Then charge was found proved, and the case adjourned for a week to enable her friends to arrange for the safety of the accused.

IMPORTANT QUESTION AS TO ABATEMENT OF RENT

At Kilmarnock Small Debt Court yesterday Sheriff Hall gave judgment in an action at the instance of Mrs. Elizabeth Scott or Straub, Eglinton Place, Saltcoats, against Thomas Dickson Ormiston, spirit dealer, there, for payment of £9 5s, being rent for half-year from Martinmas, 1897, to Whitsunday, 1898, of a public-house at the corner of Bradshaw Street and Hill Street, Saltcoats, let by the pursuer to the defender under a lease.

Defender lodged a counter-claim of £8 13s for loss and damage which he alleged he had sustained in consequence of building operations which had been carried on my Mr. Peter Kerr, an adjoining proprietor.

It appears that the public-house adjoins the building stance belonging to Kerr, which was vacant when the lease between the pursuer and the defendant was entered into, but on which, towards the end of the year 1897, Kerr set about erecting a dwelling-house. This dwelling-house is built against the gable of the public-house, thus blocking up the solitary window by which one of the back rooms was lighted. It has also been raised to a height considerably exceeding that of the public-house, in consequence of which a chimney in the latter failed to draw, and while this state of matters lasted the fire in one of the front rooms could not be lighted.

In April last a flue was added to the chimney, by which the inconvenience was so far removed that the defender only claimed an abatement in respect of it for the period from 5th January to 6th April.

The pursuer also proposed to introduce a borrowed light into the darkened back room by making a window in the partition between it and the front room, and even engaged tradesmen to carry out the operation. This the defender refused to permit, on the ground that such a window would spoil both rooms for the purpose of his business, and would be quite ineffectual as a remedy, and on the latter point the pursuer’s own tradesmen were not themselves very sanguine.

The back room accordingly remains as before, and the defender claimed an abatement in respect of it from 5th January to 15th May.

The Sheriff remarked: -

“I have found the case to be attended with some difficulty. The pursuer is absolutely free from blame in connection with the matter and has used her utmost efforts to remove all cause of the complaint. At the same time, I cannot doubt that by the law of Scotland a tenant who has been deprived, though without then act or privity of his landlord, by the operation of a third party, or by ‘damnum fatale of the beneficial occupancy of a part of the subject let, is entitled to a proportional abatement of rent.

On the whole, looking to the large sum which the defender gave for the goodwill, and which, as has been frequently laid down in the Valuation Appeal Court, is truly rent paid in advance, I think he is entitled to some compensation for the inconvenience to which he has been subjected. With regard to the extent of that inconvenience, however, there is, I think, much exaggeration in the evidence.

Taking all the circumstances into consideration, I have come to the conclusion that in respect of both rooms the defender is entitled to an abatement of £2.”

His Lordship did not allow expenses to either of the parties.

STABBING CASE

At Kilmarnock Sheriff Court yesterday, JAMES McGRATTEN, a labourer, residing in Chapelwell Street, Saltcoats, was charged with having in his own home there, on the 12th instant, assaulted the wife of Samuel Whitelaw, chimney-sweeper, by cutting or stabbing her on the left arm with a knife.

He pleaded guilty to simple assault.

The Procurator-Fiscal accepted this plea, as it was possible that the knife was used inadvertently in the course of a quarrel and scuffle which took place in the house.

The wound inflicted was not of a serious nature.

The Sheriff fined McGratten £2, with the alternative of 20 days imprisonment.

ROAD TRUSTEES

Yesterday a meeting of Irvine District Committee met in the Town Hall, Saltcoats – Mr. Brownlee of Monklands presiding.

Dr. Brown moved that all gates be removed from public roads in the district. Provost Hogarth seconded the motion, which was agreed to unanimously.

It was reported that the sub-committee recommended the removal of four posts erected in New Street, Stevenston, by the Telephone Company, and this had since been done.

It was agreed to build up openings in the wall at Stevenston Burn.

Dr. Brown, on behalf of Mr. A. Kerr, brought up the question of paving Countess Street, Saltcoats, and suggested that the Road Trustees should grant an addition to the 2s per yard already promised for paving with square setts. He gave notice of a motion for next meeting, but withdrew it as it was pointed out that it was irregular.

A letter was read from the clerk to Ardrossan School Board as to making pavements opposite Saltcoats School, but the meeting decided that the Road Trustees were not entitled to form the pavements.

SALTCOATS – SALE OF WORK

The three days’ sale of work in connection with the E.U. CONGREGATIONAL CHURCH proved a great success.

The total drawings for the three days amounted to £662, being £162 in excess of the sum aimed at by the promoters.

The object of the sale was to provide funds for the erection of a hall on a site next to the church in Hamilton Street.
