I don't think they have to actually declare him dead .I know divorce was that dear, that most never bothered with any of it.

SC, thanks for that....when Susannah's daughters were born in Scotland, she stated on their birth certificates, that she "had neither seen, nor heard from Samuel Clarke for seven and ten years" respectively (Sarah was born 1907 and Annie 1910)…..I have searched for any record of her having him declared deceased, but to no avail......there was also a rumour in the family that Samuel came to Scotland about 1907/8, looking for his two sons, but returned to Ireland without them, never to be heard of again.....again those that would have known are sadly now long gone......

FamilySearch has added 3,127,594 records from the National Archives of Ireland's collection of prison registers to its free database.
edit-findmyPast may have them ,or the paper report.

The usual case in these circumstances ,are either the wife knows her husband has died or they wait 7 yrs to pronounce him dead as there has been no contact.

Edit-There is not a marriage showing up in Irish records ,they go up to 1921 then the country splits.

Not wishing to go over old ground, but, there was a rumour in the family that on his release, Samuel went back to the Dundrum area, and worked on the land, and "possibly" had another family, although we have never found any evidence for this.....Susannah re-married in Scotland in 1912, and said that she was a widow....whether Samuel knew about her two illegitimate daughters, born in 1907 and 1910, or not, I guess we will never know.....

Thanks, we believe that Samuel Clarke is the "male child"......so we have his birth, his marriage, newspaper reports of the assault, and his court appearance, but not his death......so far.....what we really need is a record of his time in jail, and of his release.....where DID he go ??…...
